Child Custody in Alabama

Joint child custody is a common arrangement in today's Alabama divorces. Joint custody is usually the default arrangement, unless one parent can be shown to be unfit. In such cases, one parent will often get primary child custody, with the other parent receiving visitation rights. It is rare for an Alabama family court to completely deny a parent all visitation; the court is more likely to order supervised visitation than to deny visitation altogether.

Alabama's child support guidelines calculate child support based on each parent's income and the percentage of time each parent spends with the children. Modifications of child custody or child support orders may be necessary after a divorce is final. For example, if one parent plans a relocation, the custody and visitation order may have to be renegotiated to account for the parent's new location. If the income of the paying parent changes, the child support order may require modification.
